  • 1.  Homeowners Association tax filing

    I recently became the treasurer of our HOA and found out that, since it was founded and incorporated in the 1980s, they have never filed a tax return. Is there a way for us to become compliant and file tax returns going forward without suffering penalties for not filing for previous tax years? I appreciate any advice you can offer!

    Hi Jamie - I was in the same position three years ago and just started filing.  I have never received a letter from the IRS regarding the unfiled returns.  That could be that the HoA spends all of its funds for association matters.

    When I was the secretary for my HOA, I filed returns as well despite none being filed for decades before. Your HOA should be filing a 990 return or an 1120-H, an informational return only.
